These Terms of Use apply to all games, user forums, and other services provided by ALASKA SYSTEMS AND SOFTWARE LLC under these Terms of Use. The corresponding contractual partner refers to the information on the respective website (the "Provider") that references these Terms of Use. These Terms of Use govern the relationship between the respective user and the respective game provider. Additional terms of use, rules, participation requirements, and communication rules for the respective games are established by the respective provider and published as appropriate on their website, forums, or within the games. Users acknowledge that these game rules are binding on their participation in the respective games. In the event of any inconsistency between these Terms of Use and the game rules, the Terms of Use shall prevail unless the game rules explicitly state their precedence over the Terms of Use.
Prohibited Activities
The Provider's services are prohibited from being used for commercial purposes or related to commercial purposes (e.g., disseminating advertisements for third-party games, selling virtual goods), unless the Provider has expressly permitted such use in writing in advance.
Any activities related to this offer that violate applicable laws, infringe on third-party rights, or violate principles of minor protection are prohibited. In particular, the following actions are prohibited:
Posting, distributing, providing, and promoting pornographic content, games, services, and/or products that violate youth protection laws, data protection laws, and/or other laws and/or are fraudulent;
Using content that insults or defames other users or third parties;
Using, providing, and distributing content, games, services, and/or products protected by law or subject to third-party rights (e.g., copyright) without explicit authorization.
Furthermore, regardless of whether they violate the law, the following activities are also prohibited when using the offer and communicating with other users:
Spreading viruses, Trojans, and other harmful files;
Sending spam or junk emails and chain letters;
Disseminating offensive, pornographic, obscene, or defamatory content or communications, as well as content or communications that promote or support (explicitly or implicitly) racism, fanaticism, hatred, violence, or illegal activities;
Harassing other participants, such as making multiple personal contacts without the other participants' response or disregarding their responses, and advocating or supporting such harassment;
Requesting other participants to disclose their passwords;
Inducing other participants to disclose personal information for commercial or illegal purposes;
Distributing and/or publicly reproducing content provided in the game, unless explicitly permitted by the respective author or as clearly provided as a feature of the respective game.
Any actions that may affect the smooth operation of the services, especially those that may overload the Provider's systems, are illegal. In particular, the following actions are prohibited:
Using or promoting tools that interfere with the game status or process (especially so-called "bots," "hackers," or "cheats");
Fully or partially blocking, covering, redirecting, or modifying the games or content provided by the Provider;
Purchasing, selling, gifting, trading, exchanging, and providing premium features (especially virtual currency) or other game content (including game characters) in the "real world" for real money, particularly so-called "gold selling";
Intentionally exploiting program errors for personal gain (so-called "exploits");
Pretending to be employed by or working for the Provider and making statements to other users.
Termination
Users may request the Provider to delete their game registration created separately at the Provider at any time. This request also applies to the overall termination of the user account. Upon termination of the user account, all games or other services assigned to that user account will also be affected. Any premium features obtained through deleted games prior to this will become invalid, and the user will not be entitled to a refund.
The right of both parties to temporarily terminate the contract for good cause remains unaffected by the above terms. In particular, the Provider has the right to terminate the contract for good cause if:
The user violates the law, these Terms of Use, or the special terms of use for premium features (especially virtual currency) and continues to violate the rules in the same or similar manner despite being warned.
Amendments to the Terms of Use
The Provider reserves the right to modify or extend these Terms of Use at any time, and the modifications or extensions will be effective in the future, provided that the modifications are necessary and do not violate the principle of good faith to the detriment of the user. It is especially important to note that modifications may need to be adjusted based on changes in legal situations. Newly published court rulings are also considered changes in legal situations. Changes and further developments in the games may also necessitate the modification or supplementation of these Terms of Use.
