Terms of Use

These Terms of Use apply to all applications and other services provided by ALASKA SYSTEMS AND SOFTWARE LLC under these Terms of Use. The relevant contractual partner is identified on the respective website that references these Terms of Use (the “Provider”).
These Terms of Use govern the relationship between the relevant user and the Provider of the application. Additional terms of use, rules, participation requirements, and communication rules for individual applications are established by the respective service providers and may be published on their websites or within the applications. Users acknowledge that such application rules are binding upon their participation in the relevant application. In the event of any inconsistency between these Terms of Use and the application rules, these Terms of Use shall prevail unless the application rules expressly state that they take precedence.
Prohibited Activities
The Provider’s services may not be used for commercial purposes or for purposes related to commercial activities (for example, distributing advertisements for third-party applications or selling virtual goods) unless the Provider has given prior express written permission.
Any activity related to the services that violates applicable law, infringes the rights of third parties, or violates principles for the protection of minors is prohibited. In particular, the following actions are prohibited:
- Publishing, distributing, offering, or promoting pornographic content, applications, services, and/or products that violate youth protection laws, data protection laws, and/or other laws, or that are fraudulent;
- Using content that insults or defames other users or third parties;
- Using, offering, or distributing content, applications, services, and/or products protected by law or third-party rights, such as copyright, without express authorization.
Furthermore, whether or not such conduct is illegal, the following activities are prohibited when using the services or communicating with other users:
- Distributing viruses, Trojan horses, or other harmful files;
- Sending spam, unsolicited messages, or chain letters;
- Distributing offensive, pornographic, obscene, or defamatory content or communications, or promoting or supporting, explicitly or implicitly, racism, bigotry, hatred, violence, or illegal activities;
- Harassing other participants, such as repeatedly contacting them without receiving a response or disregarding their replies, or supporting or advocating such harassment;
- Requesting that other participants disclose their passwords;
- Inducing other participants to disclose personal information for commercial or illegal purposes;
- Distributing and/or publicly reproducing application content unless expressly authorized by the author or expressly provided as a feature of the application.
Any conduct that may interfere with the smooth operation of the services, particularly conduct that may overload the Provider’s systems, is prohibited. In particular, the following actions are prohibited:
- Using tools that manipulate or interfere with application status or processes, especially so-called “bots,” “hacks,” or “cheats”;
- Fully or partially blocking, overlaying, redirecting, or modifying applications or content provided by the Provider;
- Intentionally exploiting software errors for personal gain (so-called “bug exploitation”);
- Pretending to be employed by or working for the Provider and making statements to other users in that capacity.
Termination
The right of either party to terminate the contract temporarily for good cause remains unaffected. In particular, the Provider is entitled to terminate the contract for good cause if a user violates the law, these Terms of Use, or special terms of use for premium features, and continues to violate the rules in the same or a similar manner after receiving a warning.
Use Amendments to These Terms
The Provider reserves the right to amend or extend these Terms of Use at any time with future effect, provided that such amendments or extensions are necessary and do not unfairly prejudice the user’s interests in violation of the principle of good faith. In particular, amendments may be required due to changes in the legal situation. Newly published court decisions shall also be considered changes in the legal situation. Changes to and further development of the applications may also make it necessary to amend or supplement these Terms of Use.
